Please read this page carefully. This agreement constitutes the Terms and Conditions under which you may use CGJobs ("we", "us" "our"), an on-line service to post and search employment opportunities and user resumes.
Your use of CGJobs constitutes your agreement to the following Terms and Conditions. If you do not agree with any of the Terms and Conditions stated within, please do not use CGJobs or any associated services.
These Terms and Conditions are subject to change at any time. Any use of CGJobs following the posting of any new or modified Terms and Conditions constitutes your acceptance of the modified Terms and Conditions.
Except as expressly provided in any additional agreement, additional Terms and Conditions for areas of CGJobs, on particular web pages, these Terms and Conditions constitute the entire agreement between you and CGJobs.
We have the right to amend these and any Terms and Conditions at any time.
Changes to these Terms and Conditions shall be made by a revised posting on CGJobs. You should visit CGJobs periodically to review the Terms and Conditions, because they are binding on you.
Registration and Password Information
You are responsible for maintaining the confidentiality of your information and password. You shall be responsible for all uses of your registration, whether or not authorized by you. You agree to immediately notify us of any unauthorized use of your registration or password.
We reserve the right to offer third party services and products to you based on the preferences that you identify in your registration and at any time thereafter; such offers may be made by us or by third parties.
Our Advertising Rules should be read in conjunction with these Terms and Conditions.
The following actions constitute a new/additional job ad under this agreement: reposting an archived or deleted job ad; extending a job ad; changing a classification and refreshing any job ad; changing industry and occupation categories. Changes to job ad body copy, ad title, work type, do not constitute a new job ad.
Advertisers may access and use the information stored on the resume database and employment CGPortfolio solely for the purpose of identifying job seekers whose work preferences for location, work type, industry and occupation match the advertisers current job ads on CGJobs. Advertisers must not use or forward any resume without the job seekers permission.
Advertisers must ensure that job ads are posted to the appropriate category and the onus is on advertisers to ensure that they familiarise themselves with the available categories. We reserve the right to re-classify job ads without notice.
We may, without prior consultation or notice to the advertiser, delete or amend any job ad in any terms whatsoever, if in our sole opinion, we perceive the publication of the job ad would be in breach of any: relevant law; pre-existing CGJobs agreement; personal rights or is offensive. Should we delete or amend the job ad, the agreed price shall not be reduced. We will not be liable in any manner whatsoever for such alterations and the consequences thereof.
The positioning or placement of a job ad is at the discretion of CGJobs.
We are not liable to the advertiser for any loss of any nature arising from: our total failure to publish a job ad; our failure to publish a job ad in the form prescribed. This applies regardless of the cause of the failure, including if we were negligent or acted as permitted under these Terms and Conditions. In the case of total non-publication the advertiser will not have to pay any amount to CGJobs and otherwise a reduced amount may be payable according to circumstances. If we have quoted a rate to publish a specific quantity of advertising over a specific period and a lesser quantity is submitted for publication within that period then the full charge will still apply.
We make no guarantees as to the level of success a user may achieve by using the service.
We make no guarantee that job ads will be accessible for the entire term of listing. Computer outages, software failure and other technical and non-technical issues may cause temporary outages that we shall not be held liable for.
The advertiser accepts responsibility, and agrees to pay for any purchases that are transacted from their advertiser account.
Advertisements for positions vacant must be posted onto CGJobs individually. We will not accept job ads for multiple positions compiled into one job ad. We have the right to remove any such job ad at our own discretion.
Advertisers may include hyperlinks within job ads that link directly to their own company website or profile hosted on the website. Advertisers are not permitted to include hyperlinks to any other employment website. All click-through URLs must enable the browsers back feature to allow users to return to CGJobs.
You agree that your advertisements may be made available to or on the job boards of our networked partners. If you do not want your job ads listed on additional job boards for free, you need to email email@example.com with your request.
No party may upload any items that are deemed offensive by us. This includes creating hyperlinks to materials deemed to be offensive by us. Additionally no items may be uploaded that are designed to damage our systems or designed to crack our system or extract protected data.
We may provide your job ad to any other party either for publication in hard copy newspapers or for publication on other relevant and appropriate websites (as determined by us at our absolute discretion). You consent to such use and job ad republication.
We do not review every job ad, and we reserve the right to withdraw without notice any job ad that may be in breach of any clause of this agreement or of any law or regulation.
We may at our absolute discretion refuse to publish any job ad without giving any reason. In case of refusal, no charge to the advertiser shall be incurred.
We reserve the right to terminate this agreement if the advertiser posts any job ad that may be in breach of any law or regulation.
We reserve the right to, at our absolute discretion, reject or remove any job ad from CGJobs for any reason.
As a condition of using any services supplied by CGJobs, advertisers must comply with any relevant; Human Rights; Equal Opportunity; Anti-Discrimination; or any other legislation designed to protect employer / employee rights; legislation applicable in the advertisers location in which they conduct business. Where an exemption to comply with any legislation has been granted, the exemption details must be included in the job ad submitted.
You are solely responsible for your CGJobs account information, content, messages or other information that you submit, publish or display on CGJobs or transmit to other users.
By posting content on CGJobs, you automatically grant, and you represent and warrant that you have the right to grant, to us and our affiliates a royalty-free, perpetual, irrevocable, sub-licensable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any rights that may exist in such content. You also warrant that the holder of any rights, including moral rights in such content, has completely and effectively waived all such rights and validly and irrevocably granted to you the right to grant the license stated above. Subject to the foregoing, the owner of such content placed on CGJobs retains any and all rights that may exist in such content.
We act as a passive conduit for the online distribution and publication of content and have no obligation to screen communications or information in advance and are not responsible for screening or monitoring content posted by users. However, we may review and delete any content that, in our sole judgment, violates these Terms and Conditions, violates applicable law, rule or regulation, is offensive or illegal or violates the rights of, harms or threatens the safety of users of CGJobs. We reserve the right to expel users and prevent their further access to CGJobs for violating the Terms and Conditions or applicable law, rule or regulation and the right to remove content which is in violation of the Terms and Conditions, abusive, illegal, or disruptive. We may take any action with respect to content that we deem necessary or appropriate if we believe it may create liability for us or may cause us to lose (in whole or in part) the services of our ISPs or other suppliers.
The following is a partial list of content that is prohibited on CGJobs. The list below is for illustration only and is not a complete list of all prohibited content. Content is prohibited if it; is implicitly or explicitly offensive, such as content that engages in, endorses or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; harasses, incites harassment or advocates harassment of another any group or individual; involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming"; promotes or endorses false or misleading information or illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous; promotes or endorses an illegal or unauthorized copy of another person's copyrighted work, such as providing or making available pirated computer programs or links to them, providing or making available information to circumvent manufacture-installed copy-protect devices, or providing or making available pirated music or other media or links to pirated music or other media files; contains restricted or password only access pages, or hidden pages or images; displays or links to pornographic, indecent or sexually explicit material of any kind; provides or links to material that exploits people under the age of 18 in a sexual, violent or other manner, or solicits personal information from anyone under 18; or provides instructional information about illegal activities including without limitation, making or buying illegal weapons, violating someone's privacy, or provides or creates computer viruses or pirating any media; and solicits passwords or personal identifying information from other users.
To protect our users from commercial advertising or solicitation, we reserve the right to restrict the number of e-mails which users may send to other users in any period to a number which we deem appropriate.
Any rankings or other such rating system applied to users do not necessarily guarantee performance results or capture all criteria that may be relevant to an employment decision. We do not independently verify the information provided by users or the identity of users.
We do not represent or guarantee the truthfulness, accuracy, or reliability of content or any other communications posted by users or endorse any opinions expressed by users. You acknowledge that any reliance on material posted by users will be at your own risk.
We have no obligation to screen user content in advance and are not responsible for screening or monitoring content posted by users. If notified by a user of communications or content which allegedly do not conform to these Terms and Conditions, we may investigate the allegation and determine whether to take any other action including removal of the content. We have no liability or responsibility to users for performance or non-performance of such actions.
We appreciate hearing from our users and welcome your comments regarding CGJobs and our services. Please be advised, however, that we do not accept or consider unsolicited creative ideas, suggestions, inventions or materials other than those which we have specifically requested. If you send us creative suggestions, ideas, drawings, concepts, inventions, or other information such submission shall be the property of CGJobs. None of the submission shall be subject to any obligation of confidentiality on our part and we shall not be liable for any use or disclosure of any submission. We shall own exclusively all now known or later discovered rights to the submission and shall be entitled to unrestricted use of the submission for any purpose whatsoever, commercial or otherwise, without compensation to you or any other person.
We authorize you to view and access a single copy of the content available on or from CGJobs solely for your personal use. The contents of CGJobs, such as text, graphics, images, logos, button icons, software and other CGJobs content, are protected under both Australian and foreign copyright, trademark and other laws. All CGJobs content is the property of CGJobs or its content suppliers or clients. The compilation (meaning the collection, arrangement and assembly) of all content on CGJobs is our exclusive property and protected by Australian and international copyright laws. Unauthorized use of our content may violate copyright, trademark, and other laws. You must retain all copyright, trademark, service mark and other proprietary notices contained in the original CGJobs content on any copy you make of the content. You may not sell or modify our content or reproduce, display, publicly perform, distribute, or otherwise use our content in any way for any public or commercial purpose. The use of our content on any other web site or in a networked computer environment for any purpose is prohibited. You shall not copy or adapt the HTML code that CGJobs creates to generate any content or the pages making up CGJobs which is also protected by our copyright.

CGJobs contains links to third party web sites. We are not responsible for the content of linked third-party sites. These links are provided solely as a convenience to you and not as our endorsement of the contents or accuracy of materials on such third-party web sites. If you decide to access linked third party Web sites, you do so at your own risk.
Specific Prohibited Uses
CGJobs or our services may not be used for any illegal or unlawful purposes. We reserve the right to terminate usage by any party that we deem questionable. The following practices are specifically prohibited;
Entering data that is knowingly inaccurate, incomplete or false.
Entering data that does not belong to you. Users may not enter data for another user. This shall include, but not be limited to, the listing of job ads. You may not post job ads that are not for your company. The only exception to this is if you represent an ad agency, recruitment firm, or third party recruitment service, with permission to post on a company's behalf.
Maintaining an excessive amount of data on our servers or uploading anything that may cause excessive strain on our systems and networks.
Using our services for anything other than their intended uses. This shall include, but not be limited to, the practice of posting job ads that do not specifically exist, for the purpose of collecting resumes or other data from users. This practice is explicitly restricted and shall result in cancellation of your posting and removal of your usage rights.
Using our services with the intent of hurting, damaging, destroying, or otherwise infringing on the stability and usefulness of our services.
Distributing protected materials to any third party. This may include contact data, passwords, discounts, etc. This includes the sharing of protected data with other users. No party may utilize data from CGJobs in an attempt to bypass our security and extract protected data from outside sources. We reserve the right to alter, edit, or remove any data posted.
Aggregating, packaging, spidering, collecting, displaying any of the content on CGJobs without our written consent.
Copying, duplicating or using any of the coding, mark-up language, or software that comprises CGJobs or any of its services. None of these items may be reverse-engineered or duplicated for any purpose.
Posting any incomplete, false or inaccurate biographical information or information which is not your own accurate resume (living individual seeking employment on a full-time or part-time basis on his or her own behalf).
Posting any franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, pays commissions only (except for postings that make clear that the available job pays commission only and clearly describes the product or service that the job seeker would be selling, in which case such postings are permissible), requires recruitment of other members, sub-distributors or sub-agents.
Using the CGJobs resume / CGPortfolio database for any purpose other than as an employer seeking employees, including but not limited to using the information to sell or promote any products or services.
Sending unsolicited mail or e-mail, making unsolicited phone calls or sending unsolicited faxes regarding promotions and/or advertising of products or services to a user of CGJobs.
Deleting or revising any material posted by any other person or entity.
Using any device, software or routine to interfere or attempt to interfere with the proper working of CGJobs or any activity being conducted on CGJobs.
Taking any action which imposes an unreasonable or disproportionately large load on CGJobs infrastructure.
Disclosing to or sharing your CGJobs password with any third parties or using your password for any unauthorized purpose.
Using or attempting to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, or intelligent agents) to navigate or search CGJobs other than the search engine and search agents available from CGJobs.
Attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of CGJobs.
Aggregating, copying or duplicating any of the information available from CGJobs.
Framing of or linking to any of the content or information available from CGJobs.
Using the job posting and resume database features of CGJobs for unlawful purposes.
Term and Termination
These Terms and Conditions will remain in full force and effect while you are a user of CGJobs at any level.
We reserve the right to pursue all of our legal remedies, including but not limited to deletion of your content from CGJobs and immediate termination of your registration with or ability to access CGJobs and/or any other services provided to you by us, upon any breach by you of these Terms and Conditions or if we are unable to verify or authenticate any information you submit to us.
We reserve the right to change the contents of CGJobs or to discontinue it at any time, as well as the right to deny access to any person whom we have reasonable grounds to believe may be using CGJobs for an unlawful or unauthorized purpose or in a manner that may harm us.
Even after you are no longer a user of CGJobs, these Terms and Conditions will remain in effect. Termination of this agreement will not end those provisions that are capable of surviving the ending of this agreement.
Credit and Payment
Payment for job postings or job packs or any other service must be made by credit card.
A request for advertising on CGJobs will be activated on receipt of payment by us.
Interruption of Service
We provide no warranty to users that services generally available through CGJobs will be uninterrupted or error free. We agree to use our reasonable endeavours to ensure that any disruptions to or a denial of access will be remedied as quickly as possible.
We will not be liable for any delay or failure to perform our obligations under this agreement.
All sales are considered final once the job request is posted or when the credit card has been charged for the posting.
We cannot and do not guarantee or warrant that files available for downloading or delivered via electronic mail will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties.
Users are responsible for implementing sufficient procedures and checkpoints to satisfy their particular requirements for accuracy of data input and output, and for maintaining a means for the reconstruction of any lost data.
We collect your personal information to assist us in providing the goods or services you have requested and to improve our products and services. We or any of our related companies may be in touch to let you know about goods, services or promotions which may be of interest to you. We may also share your information with other persons or entities who assist us in providing our services. We would like to share your information with these overseas related companies so that they can contact you with offers. If you would prefer us not to do this, please write to our privacy officer at firstname.lastname@example.org. You can gain access to your personal information by contacting our privacy officer.
Users may not access, collect, record, alter or interfere with account data that does not belong to them. Any attempts or successes at violating another users data or privacy shall result in breach of this agreement and may result in criminal or civil proceedings.
Copyrights and Trademarks
CGJobs as a whole is copyrighted as a collective work, and individual works appearing on or accessible through this site are likewise subject to copyright protection. You agree to honour the copyrights in this site (including the selection, coordination and arrangement of the contents of this site) and in the works available on or through this site. You may download and maintain single copies of designated materials for your personal use only or as directed in any agreement.
In addition, trademarks and trade dress belonging to us or to others appear on or are accessible through this site. The fact that we have permitted you access to this site does not constitute authorization to reproduce our trademarks or trade dress for any other purpose.
By submitting any material to us, such as by posting a comment to a discussion group, or by sending us an email, you are granting to us a non-exclusive license to reproduce, display, distribute, modify and create derivative works from such material and to use such material and the fact of your authorship of it for marketing purposes.
Disclaimer of Consequential Damages
IN NO EVENT SHALL CGJOBS, ITS SUPPLIERS, OR ANY THIRD PARTIES MENTIONED ON ANY CGJOBS SITE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE ANY CGJOBS SITE AND THE CGJOBS CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT CGJOBS IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Disclaimer of Warranty
CGJOBS DOES NOT WARRANT THAT ANY CGJOBS SITE WILL OPERATE ERROR-FREE OR THAT ANY CGJOBS SITE AND ITS SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. WE DISCLAIM ANY AND ALL LIABILITY TO YOU ARISING OUT OF INTERRUPTION OR DAMAGE TO YOUR COMPUTER SYSTEM OR SOFTWARE AS THE RESULT OF ACCESSING OR OTHERWISE USING THIS SITE. WE NEITHER WARRANT NOR REPRESENT THAT THE SERVICES OR INFORMATION AVAILABLE THROUGH THIS SITE WILL ENABLE YOU TO ACHIEVE ANY PARTICULAR RESULT OR OUTCOME, LEGAL, ECONOMIC, EDUCATIONAL, OR OTHERWISE. IN THE EVENT THAT ANY OF THE FOREGOING LIMITATIONS AND DISCLAIMERS IS INEFFECTIVE, YOU AGREE THAT CGJOBS MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH ANY CGJOBS SITE OR YOUR USE OF THE CGJOBS CONTENT, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE), WILL NOT EXCEED $100.
Warranty, Liability and Indemnity
CGJobs acts as a venue for employers to post job opportunities and candidates to post resumes and does not screen or censor the listings offered. We are not involved in the actual transaction between employers and candidates. As a result, we have no control over the quality, safety or legality of the jobs or resumes posted, the truth or accuracy of any content, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings.
You agree to defend, indemnify, and hold harmless CGJobs, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from: any material you provide to us; any web site content that you use or; your breach of the terms of these Terms and Conditions. We shall provide notice to you promptly of any such claim, suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit or proceeding.
There are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretences. You assume all risks associated with dealing with other users with whom you come in contact through CGJobs.
CGJobs cannot and does not confirm that each user is who they claim to be. Because we do not and cannot be involved in user-to-user dealings or control the behaviour of participants on CGJobs, in the event that you have a dispute with one or more users, you release us (and our agents and employees) from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
If you are a California resident, you waive California Civil Code d1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favour at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."
You agree that you will use caution and common sense when using CGJobs.
CGJobs makes no representation or warranty in relation to the number of visitors to its websites or the number of impressions at any site.
CGJobs content may contain inaccuracies or typographical errors. We make no representations about the accuracy, reliability, completeness, or timeliness of CGJobs content. The use of CGJobs and its content is at your own risk. Changes are periodically made to CGJobs and may be made at any time.
You are solely responsible for the form, content and accuracy of any resume, job ad or material contained therein placed by you on CGJobs. Employers are solely responsible for their postings on CGJobs.
We are not to be considered to be an employer with respect to your use of CGJobs and we shall not be responsible for any employment decisions, for whatever reason made, made by any entity posting jobs on CGJobs.
We cannot guarantee and do not promise any specific results from use of CGJobs. No advice or information, whether oral or written, obtained by a user from us shall create any warranty not expressly stated herein.
We have no liability and the advertiser indemnifies CGJobs in relation to any failure of telecommunications services or systems which affect the receipt by CGJobs of a job ad or the publication of a campaign.
By lodging material including electronic material or data for publication or authorising or approving the publication of any material with CGJobs, you warrant that the material complies with all relevant laws and regulations and that its publication will not give rise to any claims or liabilities against CGJobs, its directors, employees or agents.
Advertisers indemnify and will keep indemnified CGJobs, its officers, employees and agents against all claims, actions, suits, liabilities, actual or contingent costs, damages and expenses incurred by us in connection with; any breach of this agreement by the advertiser; any negligent act or omission by the advertiser; the listing or proposed listing of any job ad by an the advertiser on CGJobs; or an actual or alleged breach by the advertiser of any law, legislation, regulations, by-laws, ordinances or codes of conduct; defamation, libel, slander of title; infringement of copyright; infringement of trade marks or names of publications titles; unfair competition; breach of trade practices or fair trading legislation; violation of rights of privacy or confidential information or licenses or royalty rights or other intellectual property rights which occur a consequence of the job ad appearing on CGJobs.
We make no guarantees as to the accuracy or truthfulness of any data posted within CGJobs. Any damage incurred by reliance upon this information is not our responsibility or of our affiliates or partners. By using this site, you assume all responsibility for and risk arising from your use of and reliance upon the contents of CGJobs.
References and links to products and services belonging to third parties are provided for your convenience and do not represent our endorsement of such products or services. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term.
We reserve the right to investigate and take legal action against anyone who engages in any illegal or prohibited conduct or otherwise violates these Terms and Conditions, including removing the user content from CGJobs and/or terminating the offending user's ability to access CGJobs and/or use CGJobs services. We may take any other action with respect to user content or user actions that we deem necessary or appropriate if we believe it may create liability for us or may cause us to lose the services of our ISPs or other suppliers.
